JUIZ FEDERAL CONCEDE LIMINAR VS. HIDROVIA TIETE-PARANA'

Um juiz federal em Umuarama, Parana', Brasil ha concedido um liminar
prohibindo obras do projeto Hidrovia Tiete-Parana' ate' se faz um estudo de
impacto ambiental para o projeto enteiro. Na decisão inicial do juiz Jail
Benites de Azambuja, a Cia. Energetica do São Paulo (CESP), e a Cia. Docas
do São Paulo (CODESP) também foram prohibidos a aumentar o volume de cargos
na hidrovia, do volume no ano pasado. As empresas recorreram, e esta medida
foi suspenso.

Os objetivos da açao judicial, feito por o Ministério Público do estado do
Parana', e o Ministério Público Federal foram:
a. a proteção do último remanescente do rio Parana' livre de barragens em
territorio brasileiro;
b. exigir o cumprimento da legislação ambiental, especialmente no que diz
respeito ao procedimento de licenciamento ambiental.

FEDERAL JUDGE ISSUES RESTRAINING ORDER VS. TIETE-PARANA' HIDROVIA

March 30, 1998

A federal judge in Umuarama, Parana', Brazil has issued a court order
prohibiting engineering works s part of the Tiete-Parana' Hidrovia project
until an environmental impact statement is prepared for the entire project.
In the initial decision of judge Jail Benites de Azambuja, the Energy
Company of Sao Paulo (CESP) and the Docks Company of Sao Paulo (CODESP)
were also prohibitied from increasing the volume of cargo shipped along the
hidrovia from that of last year's. The agencies appealed, and this measure
was overturned.

The objectives of the legal action, brought by the Parana' state attorney
general's office and the Federal Attorney General's office were to:
a. protect the last remaining section of the Parana' River in Brazil which
is free from dams;
b. demand compliance with environmental laws, especially where
environmental licenses are concerned.
