The Narmada Bachao Andolan (NBA) Wednesday sought President K R Narayanan's 
immediate attention on the Sardar Sarovar Project judgement of the Supreme 
Court and claimed that Narayanan had assured them of taking all necessary 
legal advice to use his "constitutional powers" in the case.

"Narayanan promised that he will take all necessary legal advise to use his 
constitutional powers to save the tribal area from destruction," a NBA 
spokesperson told reporters in New Delhi.

She said that during the 45-minute meeting the delegation led by NBA leader 
Medha Patkar, asked the President to use his special powers under Schedule 
V of the Constitution.

The delegation also requested Narayanan and his wife Usha, who was present 
during the meeting, to visit the Narmada valley and see for themselves the 
ground reality.

Meanwhile, former chief justice of the Punjab and Haryana high court 
justice (retd) V S Tewatia, who presided over the one-day public hearing on 
the issue, said, "The Supreme Court judgement is not mandatory. The 
government may still decide not to raise the height of the dam as even 
without doing it Gujarat will have as much water as it will have after 
raising it," he said.

By not raising the height the government could avoid all inconveniences, he 
remarked.

In its interim report, the panel which held the public hearing, said, "The 
callous attitude towards rehabilitation is an indicator of the immoral 
nature of the project".
