Hiding behind glossy advertisements celebrating delivery of water to the
people (of Vadodara and Ahmedabad, not of Kutch and Saurashtra) is the ugly
malice of the dam builders who will stoop at nothing to get more metres on
the dam.  After a pro-dam Majority Judgment of the Supreme Court, with just
one stipulation that rehabilitation be done prior to submergence, and none
other than the Narmada Control Authority (NCA) itself to ensure compliance,
one would not think that the pro-dam forces of the Gujarat Government would
have to resort to underhanded tricks.  Yet after the R&R subgroup of the
NCA found that rehabilitation had NOT been done for SSP oustees affected up
to the 90 m level, and recorded the same in the minutes of its April 20
meeting, the Government of Gujarat, rather than make ANY efforts to see
that affected people in all the three states were rehabilitated according
to the law, got busy getting further construction of SSP dam approved on
technicalities.

First through a legal technicality, they sought to go over the head of the
NCA and seek the advice of the Attorney General, Soli Sorabjee.  Second,
through sheer mathematical incompetence that is the norm with dam builders,
they have propounded a concept of "effective submergence" wherein they can
continue adding to the height of the dam but regulate the water level on
paper by adjusting empirical quantities like "coefficients of discharge."
(I am not making this up.)

Since when have dam builders shown ability even to measure and count basic
things properly, that now they expect us to believe they can calculate let
alone regulate flood levels with such accuracy?  That they can be trusted
to open the gates out of concern for the people?  The same government which
closed the SSP gates in December 2000, submerging the wintercrop that would
have alleviated the food shortage from the previous drought?  The same
government which ignored September tremors in Bhavnagar, raised and lowered
the reservoir level from Oct - Dec, and never bothered to fulfill the
Supreme Court Order of 1995 to do a seismic study of the dam and reservoir
area?  The same government which in ads around the world announces that
Kutch and Saurashtra can wait till next year, while installing 50 diesel
engines and a Rs. 35 crore temporary facility to pump water to the cities
"in record 120 days?"

Demand a public apology and immediate stay on humps construction!  Appeal
to Maneka Gandhi, Minister of Social Justice and Chair of NCA R&R subgroup!
 Insist that the dam height CANNOT go up while thousands of families remain
without land, and therefore no humps or further construction of any kind
can even be considered until EVERY FAMILY affected at the 90 m level is
fully rehabilitated according to the law.  Call for removal of the illegal
construction that is causing this inhumane submergence in total violation
of the law.  Humps can still be stopped, but we have very little time.
Be prepared for further actions.
