IBM US Patent #5,148,479
My note of yesterday was a grant by IBM of a covenant not to sue
implementers of Photuris for any infringement of the '479 patent. It was
not a promise to grant such a covenant. The offer of a confirmatory
license was an option IBM made available to any party that wishes to have
a written license; it was not a requirement for receipt of the covenant.
The only obligation of a party is to refrain from asserting a patent
against IBM for any IBM implementation of any IP that includes Photuris.
